If a foreign company would like to establish a subsidiary or branch in Germany, the registration has to be made in German. This implies that all necessary documents are possibly to be presented to the relevant register court in certified translation in German. These documents include, inter alia:
- Proof of the existence of the parent company, for instance by a trade register excerpt of the foreign trade register (= home register) in publicly certified form with a German translation
- A publicly certified and translated copy of the articles of association
- If German law stipulates an approval for the business or the purpose of the company, proof of the existence of the approval is to be enclosed
- Proof of the authorisation to action for third parties (natural and legal persons) in publicly certified form with a German translation; the trade register excerpt is sufficient as proof of the power of representation with managers, the executive board or the authorised representative

Certified translations of the necessary documents are also to be submitted for the registration of the commercial activity at the relevant trade office.
